Do employers in Iowa need to comply with mandatory state-specific rules when drug & alcohol testing?
Yes. Iowa has very detailed rules for employers that wish to conduct employee drug testing. Iowa’s law limiting workplace drug and alcohol testing is among the oldest in the country, enacted in 1987.
Is a Drug-Free Workplace policy required in Iowa?
Yes. All testing must be conducted by a written policy that is provided to every employee. It is also required that each applicant and employee complete a signed acknowledgment of the policy.
What are some compliance requirements in Iowa?
The law limits the discipline an employer can take in response to a positive alcohol test. Any confirmed positive test result must be communicated to a current employee by a written notice containing a list of the employee’s rights sent to the employee by certified mail, return receipt requested. Parents of a minor employee must receive a copy of the company policy and any positive test results (sent via certified mail). Split sample analysis (retest) is permitted at the employees’ expense – but the employee may only be requested to contribute an amount “consistent with the employer’s cost of conducting the initial confirmatory test.”
Are employers in Iowa able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Is supervisor training required in Iowa?
Iowa is the only state that requires initial and annual supervisor training. Iowa requires employers to conduct supervisor training on the impacts of drug abuse and how to recognize the signs of drug use (reasonable suspicion). Two (2) hours of initial training and one (1) hour refresher training is required each year.
Does Iowa authorize marijuana (THC) or cannabidiol (CBD) use?
Iowa permits the medical use of cannabidiol (CBD) for very limited medical conditions. The law does not address the workplace. CBD products must be purchased from one (1) of five (5) state-run stores.

In Iowa, if you test positive on a drug test it can be grounds for termination or a rescinded job offer.
